[Member Terms and Conditions ] * Article 1(aim) This Member Terms and Conditions(MTC) aims for familiarizing persons who are applying for membership with stipulations and for stipulating necessary articles about conditions and procedures of hotel booking system provided by BICO(c) (hereafter "Corporate") * Article 2(validity and amendment of terms) (1) MTC will be valid after being shown on the web-site(www.hoteljapan.com). (2) The Corporate can change MTC under some situation such as modifying terms of contracts with Partner-Hotel and important business reasons. Any such changes will be shown in these Terms and Conditions on the web-site and will be valid immediately * Article 3(regulations beside the MTC) In case of facts unspecified in this MTC being regulated by laws related, these laws will be abided. * Article 4(conclusion of member joining contract) (1) Member joining contract will be concluded by applicant's agreement to the MTC and Corporate approval of application. (2) Applicant must present personal information asked by the Corporate. (3) In approving application, the Corporate will notify some particulars such as ① member ID / ② day of service beginning and other particulars that the Corporate accepts. (4) The Corporate will not approve any applications in following cases: ① using others name by stealth / ② making a false description with application form of attaching an false documents / ③ application for offending against public morals * Article 5(using services) (1) Service hours are to be settled by the Corporate. (2) Service hours described in the preceding clause (1) are conditional under the Corporate rules like scheduled maintenance. (3) Even approved members are restricted from using some services under the Corporate policy. (4) Due to the Corporate performance of complex tasks such as customer payment, the Corporate restricts member ID modification without specific reasons. * Article 6(obligations of the Corporate) (1) The Corporate have to provide services to members on the beginning day unless there are special causes. (2) The Corporate have an obligation of providing services continuously and consistently in ways disclosed in our MTC. (3) The Corporate do not share member's personal information without informed permission. There are, however, some exceptions like request of the administrative machinery under the related laws and regulations. (4) In case that the member has a due claim or opinion, the Corporate must deal with it immediately. But, when it is unable to dispose instantly, the Corporate should notify causes and procedures to the member. * Article 7(obligations of the members) (1) Members are responsible for keeping their ID and password. (2) In case of one's ID being used improperly, the member should notify that. (3) Members should obey rules that the related laws and regulations and MTC stipulation * Article 8(cancellation and limitations) When the member wants to cancel joining contract, the member himself have to make request through on-line web site. The Corporate may cancel contract or break off services for a limited time in case of doings such as (1) deranging the public order or public morals (2) relating to violation of the law (3) planning to use or using services for obstructing national or public interest (4) using others ID and password by stealth (5) defamation of character or being against one's interests (6) obstructing sound use of services (7) breaching the related laws and regulations and MTC *Article 9 (limitation removal procedure) (1) According to article 8, if the corporate wants to break off services they must notify the member or his deputy by mail or call with the reason, date, time and period unless the corporate approves that the service should be stopped urgently. (2) According to article 1, The member of his deputy whose service is broken off can object to the service break off notice. (3) The corporate can hold service break off for validating against an object made according to the clause(2). The corporate should notify the result to the member or his deputy. (4) If the corporate approves that the reason for break off has been settled during break off period, they remove break off immediately. Article 10(notice put up by members)The corporate can delete any write ups or notices that members put up on the service without reporting such as: (1) Slandering or smearing other members or the third person (2) violating against public orders or morals (3) recognized as related to crime activities (4) Infringing the third person's rights such as copyright (5) violating other related statutes or policies that the corporate stipulated * Article 11 (Privacy policy) (1) © BICO shall not let out information of customers who have used booking and travel service of the corporate in any reasons. If the information is needed in other customers service(such as using an affiliate service), the corporate an provide it with the agreement of members or customers. BICO Travel Service: 81-3-5720-8228 / E-mail: hotel@hoteljapan.com * Article 12 (Contract Modification) (1) If a member wants to modify contents on the contract such as address or bank account number or close the service, he or she should modify/close contents on the contract by phone or by service. * Article 13 (Providing Information) (1) The corporate may provide various information to the member by mail or e-mail for improving member's use of service (bylaws) (day of enforcement) This MTC will come into effect from February 1st of 2002
